Jail term for husband and wife directors

Husband and wife company directors, Mr Terry William Lemon and Mrs Kayleen Gaye Lemon, of Yass, NSW, were convicted and sentenced after each pleading guilty to a charge brought by ASIC.
In 2007, Mr and Mrs Lemon were automatically disqualified from managing a corporation after being convicted of taking company funds for their own purposes. They each received a good behaviour bond.

The current sentencing relates to one charge each brought by ASIC of managing the underground cable installation company Southern Cable Services Pty Ltd whilst disqualified.

Because Mr and Mrs Lemon pleaded guilty to the charges, the Court was also required to deal with their breach of their good behaviour bonds. They were each sentenced to ten months imprisonment with a non-parole period of five months.

Individuals who are convicted of a fraud or dishonesty offence which is punishable by imprisonment for at least twelve months or more are automatically disqualified from managing corporations for five years. If the convicted individual is sentenced to a period of imprisonment, the five year disqualification period commences from the day they are released from prison.
