Sunshine Coast director fined for lodging false information with ASIC

Mr Jon Paul Anthony McKay, a Sunshine Coast based builder, pleaded guilty and was sentenced in the Maroochydore Magistrates Court on Thursday 21 August 2008 in relation to one charge of lodging false information with ASIC.
Mr McKay was convicted and fined $2,000.
The charges followed an investigation by ASIC into the lodgement of an application for deregistration of Mr McKay’s company King Refrigeration and Airconditioning Solutions Pty Ltd (the company).
ASIC alleged that Mr McKay made a false declaration in an application for deregistration of the company. ASIC’s enquiries found that Mr McKay falsely declared that the company was not involved in any legal proceedings, nor did it have outstanding debts, despite being aware that the company was the subject of an action in the Caloundra Magistrates Court.
The company has since been placed into liquidation.
As a result of Mr McKay’s conviction, he has been disqualified by ASIC from managing corporations until August 2013.
The matter was prosecuted by the Commonwealth Director of Public Prosecutions
