How is a Director Penalty Notice Served?

The Director Penalty Notice is issued to the director's home address as listed in the Australian Securities and Investments Commission (ASIC) records.

It is a directors responsibility to ensure their current residential address is maintained at the ASIC.

If a director fails to maintain their address details and a Director Penalty Notice is issued to a previous address, it IS NOT a valid defence to argue the notice was not received. That is, directors will not avoid the personal liability that follows non compliance with the notice.

In short, it is IMPERATIVE that if you move, you update your address details with the ASIC.
